ORDER OF DISMISSAL

This matter is before the South Carolina Administrative Law Judge Division ("Division") on the application of Gail D. Brockington, People for Positive Tomorrow, d/b/a The Limited Restaurant, located at 3000 W. Sumter Street, Florence, South Carolina for an on-premises beer & wine permit and sale and consumption (minibottle) license (AI-119384 & AI-119390). This application was protested by Cynthia Young, Principal of Carver Elementary School. After notice to the parties a hearing was scheduled for September 21, 1998. The Notice of Hearing was sent by certified mail, return receipt requested to the Protestant. Cynthia Young received notice on August 24, 1998. Protestant did not appear at the hearing and her protest is deemed abandoned. No other protests were made to this application.

IT IS THEREFORE ORDERED that the above-referenced matter is forwarded to the Department of Revenue to continue to process the application of Gail D. Brockington and People for Positive Tomorrow.

IT IS FURTHERED ORDERED that this matter is DISMISSED.

AND IT IS SO ORDERED.
