ORDERS:
ORDER OF DISMISSAL
In the above-captioned matter, a regulatory hearing was scheduled for 10:00 a.m. on
Thursday, November 6, 2003, at the Administrative Law Judge Division in Columbia, South Carolina.
ALJD Rule 45 requires an agency proposing a regulation to provide a statement, at least ten
days before the scheduled hearing date, confirming the need for a hearing on the regulation pursuant
to S.C. Code Ann. § 1-23-110 (Supp. 2002) because a request for a hearing was made by twenty-five
persons, a governmental subdivision or agency, or an association having not less than twenty-five
members. In the instant matter, the South Carolina Department of Revenue advised this tribunal, by
letter filed September 25, 2003, that no comments or requests for a hearing were submitted to the
Department regarding the proposed regulations identified above. Thus, pursuant to Section 1-23-110(A)(3), it is not necessary to hold a regulatory hearing in this matter.
IT IS THEREFORE ORDERED that the hearing on the proposed regulations scheduled
for November 6, 2003, at 10:00 a.m. is hereby CANCELED and this matter is DISMISSED.
AND IT IS SO ORDERED.
