ORDER OF DISMISSAL

This matter is before the South Carolina Administrative Law Judge Division ("Division") on the application of Bryan E. Stamey, d/b/a Dog Bluff Handy Mart, located at 1810 Jordanville Road, Galivants Ferry, South Carolina for an off-premises beer & wine permit (AI-119093). This application was protested by the Horry County Sheriff's Department ("Prostestant"). After notice to the parties a hearing was scheduled for July 24, 1998. The Notice of Hearing was sent certified to the Protestant. The Horry County Sheriff's Department received notice on June 22, 1998. The Protestant failed to appear at the hearing and the protest is deemed abandoned. No other protests were made to this application.

The location was previously issued an off-premises beer and wine permit, and has been continuously licensed since June 1989. Taking the protest into consideration, there is no basis on which to deny the permit.

IT IS THEREFORE ORDERED that the above-referenced matter is forwarded to the Department of Revenue to continue to process the application of Bryan E. Stamey.

IT IS FURTHER ORDERED that this matter is DISMISSED.

AND IT IS SO ORDERED.
