ORDERS:
ORDER OF DISMISSAL
This matter is before the South Carolina Administrative Law Judge Division ("Division")
pursuant to a consent agreement reached in this docket by Judy A. Alexander, d/b/a Sam's Country
Club ("Petitioner") and C. David Stone, Sheriff of Pickens County ("Protestant").
Pursuant to S.C. Code Ann. § 61-4-520 (Supp. 1997), the Petitioner applied for an on-premises beer and wine permit (AI-119438) from the South Carolina Department of Revenue
("Department"). The Sheriff of Pickens County filed a protest to said application, and the
Department transmitted the filing to the Division for contested case hearing pursuant to S.C. Code
Ann. § 61-6-1820 (Supp. 1997).
On July 13, 1998, a consent agreement between the Petitioner and Protestant was submitted
to the Division for filing. Upon review of the proposed agreement, I conclude that the agreement
should be approved. A copy of the agreement is incorporated hereto, and is attached as Exhibit A.
IT IS THEREFORE ORDERED that the Department shall issue an on-premises beer and
wine permit to Judy Alexander, d/b/a Sam's Country Club with the following restrictions:
(a) Petitioner will not have a live band after 12:00 midnight.
(b) Petitioner will close at 2:30 a.m. each morning except Saturday, on which Petitioner
will close at 12:00 midnight.
(c) Petitioner will install a fence sufficient to prevent the inadvertent crossing onto
adjacent land behind the location in question.
AND IT IS SO ORDERED.
