ORDERS:
ORDER OF DISMISSAL
This matter is before the South Carolina Administrative Law Judge Division ("Division")
on the application of Fred Crawford, Jr., d/b/a Cambles Grocery located at Route 2, Box 2030,
Gresham, South Carolina for an on-premises beer & wine permit (AI-120275). This application was
protested by Rev. Steve B. Small, of Daviston Church of God, and Mr. Lonnie C. "Bud" Richardson.
After notice to the parties a hearing was scheduled for July 20, 1998. The Notice of Hearing was
sent certified to both Protestants. Mr. Richardson received notice on June 17, 1998 and Rev. Small
received notice on June 22, 1998. Rev. Small contacted the Division on July 20, to say that he was
unable to attend the hearing. Mr. Richardson failed to appear at the hearing and his protest is
deemed abandoned. No other protests were made to this application.
The location was previously issued an on-premises beer and wine permit from May 1984 to
May 31, 1991. At the time of issuance of the permit, Daviston Church of God protested on the same
basis as the protest in this matter. Taking the protest into consideration, there is no basis on which
to deny the permit. Further, it is noted in the Department's investigation file that the applicant
proposed to have video poker machines. At the hearing, the applicant and his counsel, Kenneth
Allen, were reminded of the administrative consequences of operation of video poker machines in
a location licensed for the sale of beer and wine. Based upon the foregoing,
IT IS THEREFORE ORDERED that the above-referenced matter is forwarded to the
Department of Revenue to continue to process the application of Fred Crawford.
IT IS FURTHERED ORDERED that this matter is DISMISSED.
AND IT IS SO ORDERED.
