ORDER

This case is pending before the Administrative Law Judge Division due to a protestant filed by Chief Robert Williams, Chief of Police of the Town of Santee. By letter dated September 8, 1997, Chief Williams withdrew his protest in this case. Since no other protests were filed and since the South Carolina Department of Revenue would have granted the application but for the protest of Chief Williams, the withdrawal by Chief Williams leaves the application undisputed and presents no controversy for decision.

Accordinly, since no controversy exists, IT IS HEREBY ORDERED that the Protestant's request for withdrawal of his protest is hereby granted and this matter is ended by dismissal.

AND IT IS SO ORDERED.
