ORDERS:
ORDER
This matter comes before me pursuant to S.C. Code Ann. § 1-23-310, et seq. (Supp. 1995).
Petitioner David C. Hance, d/b/a Tripp's Mini Mart seeks an off-premises beer and wine permit (AI
113041) for a convenience store located at 215 North Pickney Street, Union, South Carolina.
After timely notice to the parties and the protestant, a hearing was held at the Administrative
Law Judge Division on August 5, 1997 in Columbia, South Carolina. The applicant failed to appear
at the hearing of this matter. Also, Reverend J. Archie Calhoun, the only protestant of record, failed
to appear at the hearing or to make a motion for a continuance; thus, protestant is deemed to have
waived his protest. Therefore, there is no opposition of record to the petitioner's application.
IT IS HEREBY ORDERED that this matter is dismissed.
IT IS FURTHER ORDERED that the Department of Revenue continue to process the
application of David C. Hance, d/b/a Tripp's Mini Mart for an off-premises beer and wine permit
(AI 113041) for a convenience store located at 215 North Pickney Street, Union, South Carolina.
AND IT IS SO ORDERED.
