ORDER OF DISMISSAL

In the above-captioned matter, the protestants, Homer and Brenda Harmon, have advised the Administrative Law Judge Division, by letter filed May 13, 1997, of the withdrawal of their protests. The protestants initially opposed the issuance of an on-premises beer and wine permit (AI 113313) to Deborah J. Mangum, d/b/a Winners World. Upon withdrawal of these protests, there is no opposition to the petitioner's application, therefore, a hearing is no longer necessary.

IT IS THEREFORE ORDERED that the hearing scheduled for Tuesday, August 5, 1997 is hereby canceled.

IT IS FURTHER ORDERED that this matter is dismissed and that the Department of Revenue continue to process the application of Deborah J. Mangum, d/b/a Winners World, for an on-premises beer and wine permit.

AND IT IS SO ORDERED.
