A letter was filed with the Court on April 24, 1997, by Sgt. John P. Lyles, Jr., stating that the Spartanburg County Sheriff's Office does not wish to protest the issuance of an alcohol license in the above matter. Sgt. Lyles is the sole protestant in this matter, and upon withdrawal of his protest, there is no opposition to Petitioner's application for a beer and wine permit

(AI #110483).

IT IS THEREFORE ORDERED that the above-captioned matter bearing Docket Number 97-ALJ-17-0015-CC is hereby dismissed and that the South Carolina Department of Revenue shall issue the beer and wine permit (AI #110483) applied for upon Petitioner's payment of the prescribed fee and bond.

AND IT IS SO ORDERED.
