ORDERS:
ORDER OF DISMISSAL
On December 5, 1996, the South Carolina Department of Revenue (DOR) forwarded to the
Court a copy of a letter which had been sent to them from Louise Anderson, the sole protestant in
the above matter and which is incorporated herein by reference. The letter sent by Ms. Anderson
to DOR was actually a letter dated November 15, 1996, from John Cuttino, Attorney for
Petitioner, to DOR upon which Ms. Anderson had handwritten a message containing a statement
that she "will not be presuing [sic] this any further." The Court contacted
Ms. Anderson by telephone to confirm her intentions, and she stated that she would not be
attending the hearing on the merits in this matter scheduled for January 7, 1997, at 11:30 a.m.
IT IS THEREFORE ORDERED that the hearing in this matter scheduled for January 7, 1997,
at 11:30 a.m. is cancelled, and the above-captioned matter bearing Docket Number
96-ALJ-17-0486-CC is hereby dismissed.
IT IS FURTHER ORDERED that the South Carolina Department of Revenue and Taxation
shall issue the off premises beer and wine permit (AI #110639) applied for upon Petitioner's
payment of the prescribed fee and bond.
AND IT IS SO ORDERED.
