ORDERS:
ORDER AND DECISION
This matter is pending before the Administrative Law Judge Division pursuant to S. C. Code
Ann. § 61-9-320 (Supp. 1995) and § 61-5-50 (Supp. 1995) for the issuance of an on-premises beer
and wine permit and business sale and consumption license to the above-referenced Petitioner, I
Barton Dumas. The applications were protested by Mel E. Jenkins of 3324 Montgomery Avenue,
Columbia, South Carolina.
Pursuant to the attached letter dated October 2, 1996 and received in the Administrative Law
Judge Division on that date, the Protestant, Mel E. Jenkins, has withdrawn his protest of the
requested applications. Therefore, since there is no longer any opposition of record, it is hereby
ORDERED that the above-captioned matter bearing Docket Number 96-ALJ-17-0406-CC
be dismissed and that the South Carolina Department of Revenue and Taxation issue the beer and
wine permit (AI #109217) and the business sale and consumption license (AI #109217) applied for
upon Petitioner's payment of the prescribed fee and bond.
AND IT IS SO ORDERED.
