ORDERS:
ORDER OF DISMISSAL WITHOUT PREJUDICE
This case has been pending before the Administrative Law Judge Division since September
3, 2002. During that time period, the parties have assured the ALJD that this case will most likely
become moot due to the significant impact of the EPA’s issuance of a revision to a permit. Due to
the anticipated mootness and due to the length of time this matter has been pending, the current case
is removed from the docket, dismissed without prejudice, and may be reinstated upon motion of either
party.
AND IT IS SO ORDERED.
