ORDERS:
ORDER OF DISMISSAL
In the above-captioned matter, by letter dated June 6, 1996, the Protestant, Sheriff C. David
Stone of the Pickens County Sheriff's Department advised the Administrative Law Judge Division that
the Protestant withdraws its protest. The Protestant's withdrawal of its protest was conditioned upon
the Petitioner consenting to the following stipulations: (1) the permitted location will close by 11:00
p.m. each day of operation; and (2) the permitted location will restrict sales of alcoholic beverages to
patrons to whom food is served, or limit the sale of alcoholic beverages to no more than three (3)
beverages per patron. By letter received June 14, 1996, the Petitioner William T. Barrett, d/b/a
Tinker's advised this tribunal that he consents to the above-mentioned stipulations being a condition to
the issuance of an on-premises beer and wine permit. The letters of the Protestant and Petitioner are
attached and incorporated by reference. Upon withdrawal of this protest, there is no opposition to the
Petitioner's application, therefore, a hearing is no longer necessary.
IT IS THEREFORE ORDERED that the hearing scheduled for Wednesday, July 17, 1996 is
hereby canceled.
IT IS FURTHER ORDERED that this matter is dismissed and that the Department of
Revenue and Taxation shall continue to process the application of William T. Barrett for an on-premises beer and wine permit and shall include the above-stated stipulations as restrictions on the
Petitioner's permit.
AND IT IS SO ORDERED.
