ORDERS:
INTERLOCUTORY ORDER
Pursuant to the Court's Interlocutory Order dated June 11, 1996, Respondent South
Carolina Department of Revenue and Taxation (hereinafter referred to as "DOR") filed a
memorandum on July 9, 1996, setting forth its agency position on certain issues addressed in the
Court's order. Respondent indicates in its memorandum that a copy was sent to Petitioner,
John H. Howard, and Protestant, Lois Malone.
IT IS THEREFORE ORDERED that if the parties and/or Protestant would like to
reconvene the hearing in the above matter, a written request must be filed with the Court on or
before July 26, 1996.
IT IS FURTHER ORDERED that if the hearing is reconvened, DOR shall participate at
the hearing by producing evidence to support its position. Any witnesses called by DOR shall be
subject to cross-examination by Petitioner. Petitioner and Protestant may offer additional
evidence.
IT IS FURTHER ORDERED that if no written request to recovene the hearing is filed
with the Court on or before July 26, 1996, the memorandum submitted by DOR dated
July 8, 1996, will be incorporated into the record, and a final order and decision will be issued in
the above matter based upon the entire record, including the transcript of the hearing.
AND IT IS SO ORDERED.
