Settlement Order

The parties in the above-captioned matter have agreed to a settlement of the issues involved in this case which was approved and consented to by separate Order. It now appearing that this case should be dismissed, it is hereby

ORDERED that the South Carolina Department of Revenue and Taxation shall issue the renewal of the applicants' on-premise beer and wine permit (AI 93641) and business sale and consumption license (AI 93642) for the premises located at 1601 Hawkins Street, Georgetown, Georgetown County, South Carolina, subject to the conditions in the Settlement Order dated May 30, 1996, and

IT IS FURTHER ORDERED that this case be and hereby is dismissed.

AND IT IS SO ORDERED.

This matter comes before me pursuant to Petitioner(s) renewal application by which they seek to renew their permit/license number BW626759, AI 93641 and SB626758, AI 93642. It now appears that the parties hereto have reached a settlement as to all matters at issue herein. The parties have reached an agreement as to all issues involved in this case and both Attorneys have moved this Court to approve said agreement.

The agreement of the parties is as follows:

1. Petitioner(s) agree to hire security for the outside of the building and the parking lot during business hours.

2. Petitioner(s) agree to post appropriate signage for their property.

3. Petitioner(s) agree to shorten their hours of operation to 2:30 a.m. each day they are open, with the exception of Saturday night/Sunday morning. Should Petitioner(s) open Saturday night/Sunday morning, their hours shall be in accord with the Statutes and applicable "blue laws".

4. Petitioner(s) will enter into a written agreement outlining the above conditions with the City of Georgetown.

5. The permits/licenses referred to herein shall be extended until midnight on December 31, 1996 at which time said permits/licenses shall expire.

6. Petitioner(s) further agree to relocate his/their business to another location and not to seek renewal of his/their license(s) or additional license(s) at the location 1601 Hawkins Street.

7. Petitioner(s) have not admitted any wrongdoing in connection with this matter. This proceeding nor this Agreement and Order will not in any form or fashion whatsoever prejudice any application by Petitioner(s) jointly or severally for a license or licenses at any new location.

I have considered the matter, and find that the Agreement of the parties should be, and hereby is adopted as the Order of this Court.

And It Is So Ordered.
