ORDERS:

CONSENT ORDER

South Carolina Reg. 61-94 requires that the charges for specific food items be within an "allowable percentile" of difference from the average price from other stores. DHEC had alleged that the Petitioner, BJ's Mini-Mart, had violated S.C. Reg. 61-94, from which the Petitioner has appealed.

The Department finds that the Petitioner is now in compliance with S.C. Reg. 61-94 and therefore no longer seeks to enforce compliance ore take action against Petitioner.

IT IS THEREFORE ORDERED that the contested case be dismissed for mootness, based on the parties' consent.

AND IT IS SO ORDERED.
