ORDERS:
CONSENT ORDER OF DISMISSAL
This matter is before the Administrative Law Judge Division on Respondent's request for a contested case hearing to
challenge Administrative Order No. 01-263-DW issued by Petitioner South Carolina Department of Health and
Environmental Control. Prior to the scheduled hearing date, the parties reached a settlement of this matter, agreeing to
voluntarily dismiss the case upon the condition that Respondent pay the Department a civil penalty in the amount of
$5,000. The parties agreed that the total penalty may be paid in four quarterly installments of $1250 each with the first
payment due thirty days after this Order is filed with the Administrative Law Judge Division. Each quarterly installment is
due ninety days after the last payment until the balance is paid. The parties further agree that Respondent will immediately
begin and continue to perform monitoring for lead and copper contaminants, as they pertain to the operation of a public
water system, in accordance with state law and regulations. Further, the Administrative Law Judge Division retains
jurisdiction over this matter.
