ORDERS:

CONSENT AGREEMENT AND ORDER

STATEMENT OF FACTS



1. Harriett Jenrette is currently the holder of a license to operate Bellwood Manor,



a Community Residential Care Facility, by the South Carolina Department of Health and



Environmental Control (Department) pursuant to S.C. Code Ann. § 44-7-110 et seq. (Supp.



1999).



2. The Department notified the Petitioner by letter dated September 26, 2000



(Attachment A), that it was imposing a monetary penalty against her for failure to provide the



Department with a copy of her current license from the Board of Long Term Care



Administrators.

3. By letter dated October 24, 2000, the Petitioner submitted a timely appeal to the



Department.



4. The parties have resolved the issues relating to this appeal, and hereby enter into



the following Agreement:



THEREFORE, IT IS AGREED



1. The Department agrees to suspend $250.00 of the $500.00 assessed monetary

penalty following execution of this Consent Agreement and Order. If the facility Bellwood Manor is found to be operating without a licensed administrator during the next twelve months, the Department may call-in all or part of these penalty amounts or may assess another penalty in accordance with S.C. Code, § 44-7-320(C) and the Licensee shall immediately pay to the Department the assessed penalty.

  • The Petitioner agrees to submit to the Department within thirty days of execution of this Consent Agreement and Order payment of $250.00. Payment is to be by check or money order made payable to the S. C. Department of Health and Environmental Control and sent to the following address:

  • Petitioner agrees that she will fully comply with Regulation 61-84, specifically Section 203 which requires that there be a licensed administrator in charge of all functions and activities at the facility and available and responsible within a reasonable time and distance.
