CONSENT ORDER TO DISMISS PETITION
A Petition for a Contested Hearing was filed on July 17, 2003 and served on the Respondent on the same date. The parties have informed the Court that they had reached an agreement as to the issues raised in the Petition for a Contested Hearing, and that agreement is as follows:

The South Carolina Budget and Control Board/ South Carolina Retirement Systems agrees that they will waive the time limit of Petitioner’s application and claim for South Carolina Retirement Systems benefits.

NOW THEREFORE, on motion of J. Mitchell Lanier, attorney for Petitioner, and with the consent of Steven Van Camp, attorney for Respondent, it is hereby

ORDERED, ADJUDGED, AND DECREED, that the above action is dismissed without prejudice to either of the parties and without further hearing.

AND IT IS SO ORDERED!
