ORDERS:
CONSENT ORDER OF DISMISSAL
This matter is before the South Carolina Administrative Law Judge Division ("Division") pursuant to Donald McCown's
Petition for a Contested Case Hearing to challenge the staff's recommendation to the Board of Health and Environmental Control
that his paramedic certification be revoked. The parties have resolved all outstanding issues and have agreed to settle this matter.
In the interest of resolving this matter without delay and expense of litigation, the Petitioner agrees to the entrance of this Order,
but neither agrees nor disagrees with the Findings of Fact or the Conclusions of Law; and the parties therefore, agree that this
Order shall be deemed an admissions of fact and law only as necessary for enforcement of this Order by the Department.
THEREFORE IT IS ORDERED:
(1) That this appeal shall be dismissed with prejudice;
(2) The Petitioner agrees to a suspension of his paramedic certification for a
period of four (4) months. This period of suspension shall begin on
January 1, 2001.
(3) That at the expiration of this four (4) month period of suspension,
Petitioner's certification will be restored, and he may resume his practice
as a Paramedic. Should Petitioner's certification lapse during this period
of suspension, Petitioner may fulfil his training requirements and renew
his certification at the end of this time.
AND IT IS SO ORDERED.
