ORDERS:
ORDER OF DISMISSAL
This matter is before the Administrative Law Judge Division (Division) pursuant to the Respondent's request for a
contested case hearing to review a decision of the Petitioner, SouthCarolina Department of Health and Environmental
Control (DHEC) to disqualify the Respondent's establishment as a WIC Program Vendor. The case is presently scheduled
for a hearing on the merits on May 23, 2000.
Pursuant to a letter from counsel for the Petitioner, which is hereby incorporated by reference and attached as an exhibit to
this Order, it appears that further investigation into the incident giving rise to this contested case has resulted in an
acknowledgement by DHEC that the Respondent's disqualification from the WIC Program was in error and that this matter
has now been resolved between the parties. Accordingly, counsel for DHEC requests, with the consent of the
Respondent's counsel, that this matter be dismissed.
IT IS THEREFORE ORDERED that this matter be dismissed.
AND IT IS SO ORDERED.
