ORDERS:

CONSENT ORDER

This matter is before me by consent of all parties for entry of a consent order. This contested case is an appeal taken by the Petitioner following OCRM's denial of permit application no. OCRM-99-199-B to Beverly Detyens. The application proposed to construct a private dock at 3339 Confield Drive, Dunes West subdivision, Mount Pleasant, in Charleston County, South Carolina. OCRM denied the permit because the Petitioner's lot was not one of those allotted a dock pursuant to the Dock Master Plan that has been submitted by the Dunes West developer.

Upon review of a revised proposal by the Petitioner, the Department has determined that a joint-use dock shall be acceptable as shown on the attachment hereto labeled Attachment A. The adjoining property owner has agreed to this arrangement. The parties agree that this agreement shall be binding on the Petitioner's heirs and assigns.

It is therefore, ORDERED that permit number OCRM-99-199-B is issued with the aforementioned modifications.

AND IT IS SO ORDERED.
