ORDERS:
CONSENT ORDER
This matter is before me by consent of all parties for entry of a consent order. This contested case is an
appeal taken by the Petitioner following OCRM's issuance of Permit No. OCRM-99-445-B to Anne H.
Russell. The application proposed to construct a private dock and bulkhead at Lot 90, Tract 5, Royal Trace
Lane, Mount Pleasant, in Charleston County, South Carolina. The bulkhead was to be 116' long and placed
along the shoreline. The dock was to consist of a 4' x 24' walkway leading to a 10' x 15' pierhead with a
roof. A ramp would lead from the left side of the pierhead to an 8' x 30' floating dock. The applicant also
proposed to construct a 12' x 20' boatlift on the right side of the pierhead. OCRM placed a special condition
on the permit requiring that the total square footage of the entire structure does not exceed 160 square feet.
Upon review of a revised proposal by the Petitioner, the Department has determined that the covered, fixed
pierhead may be 10' x 10', and the floating dock may be 8' x 20'. A drawing of this proposal is attached
hereto as Exhibit A. The parties agree that all other conditions and restrictions in the permit shall govern the
construction. The parties also agree that this agreement shall be binding on the Petitioner's heirs and
assigns.
It is therefore, ORDERED that permit number OCRM-99-445-B is issued with the aforementioned
modifications.
