ORDERS:

CONSENT ORDER OF SETTLEMENT

This contested case was scheduled for hearing before the Division on December 21, 1998. This is a Petition for review of an Administrative Enforcement Order issued by SCDHEC - OCRM seeking removal of an unauthorized seawall and non-attached deck on Petitioner's beachfront property at 661 South Waccamaw Drive at Garden City Beach, Georgetown County, South Carolina. In addition, OCRM sought payment of a $500.00 fine.

The parties have resolved this matter. In accordance with the terms of their settlement, the parties agree that Petitioner will replace the 8" x 8" timbers which comprise the privacy fence with 2" x 4" pickets with a 4" x 8" cedar cap. Removal shall be accomplished by no later than March 1, 1998. In consideration for the Petitioner's agreement to remove the erosion control device, the Respondent will waive enforcement of the $500.00 administrative fine.







Based on this agreement, as evidenced by the signatures below, this action is hereby dismissed.

AND IT IS SO ORDERED.
