ORDERS:
CONSENT ORDER OF DISMISSAL
This matter is before the Court pursuant to a Petition for Review filed by Hilton Head
Plantation Property Owners Association, seeking review of the denial of permit application
number 97-1A-439-P. On April 3, 1998, OCRM denied a permit to the Hilton Head
Plantation Property Owners Association to scrape sand from the shoreline along Park Creek
on Pine Island and place it along the shoreline between Pine Island and Dolphin Point on
Hilton Head Island. A hearing was held before the Administrative Law Judge Division on
December 10, 1998. At the hearing, issues and evidence were raised that caused the parties
to enter into settlement negotiations. Following these discussions, the parties notified the
Court that an agreement had been reached to dismiss this action.
This Consent Order has been provided to the Court by the parties and represents their
agreement that:
1. OCRM agrees to issue a permit, number 97-1A-439-P, to Hilton Head
Plantation Property Owners Association. This permit has been issued and a copy is attached
hereto.
2. Petitioner Hilton Head Plantation Property Owners Association agrees to accept
all conditions of the permit and to dismiss the appeal with prejudice.
THEREFORE, with the consent of the parties, it is hereby ORDERED that Docket
Number 98-ALJ-07-0247-CC be hereby dismissed.
AND IT IS SO ORDERED.
