ORDERS:
ORDER OF DISMISSAL
This matter was before the Administrative Law Judge Division ("ALJD") upon the request of
Michael J. Myers, Petitioner, to review the decision by the South Carolina Department of Health and
Environmental Control, Bureau of Ocean and Coastal Resource Management, to grant a permit to construct
a handicapped dune crossover with benches, a wheelchair turn-around area, and an asphalt access and
parking area on and adjacent to the Atlantic Ocean at Seashore Road, Fripp Island, Beaufort County, South
Carolina.
After the matter was transmitted to the ALJD, the Petitioner has notified the Division by letter filed
October 25, 1997 of his desire to withdraw his request for a contested case hearing. A copy is attached
hereto as Exhibit A. By withdrawing his request, it appears that no further action is required. It is therefore,
ORDERED, that the above referenced case is DISMISSED.
AND IT IS SO ORDERED.
