ORDER OF DISMISSAL

The above-entitled case is pending before the Administrative Law Judge Division. On July 15, 1997, John P. Kassebaum, II, Staff Counsel for Respondent, South Carolina Department of Health and Environmental Control, Bureau of Ocean and Coastal Resource Management, filed a Notice of Motion and Motion to Dismiss on the grounds that the Petitioner has relocated to California and would not be adversely affected by the issuance of this permit. Further, Petitioner failed to comply with the Order dated June 20, 1997, in the filing of his Prehearing Statement and failed to comply with the extension granted to him for the filing of his Prehearing Statement by July 21, 1997. Respondent, South Carolina Department of Health and Environmental Control, Bureau of Ocean and Coastal Resource Management's Motion is granted.

Therefore, IT IS ORDERED that the above-captioned case be and hereby is dismissed.

AND IT IS SO ORDERED.
