ORDERS:

CONSENT ORDER OF DISMISSAL

This contested case was scheduled for hearing before the Division on October 22, 1996. This is a Petition for review of an Administrative Enforcement Order issued by SCDHEC - OCRM seeking removal of an erosion control device constructed on Petitioners' beachfront property on Pawleys Island, Georgetown County, SC. In addition, OCRM sought payment of a $1,000.00 fine.

The parties have resolved this matter. In accordance with the terms of their settlement, the parties agree that Petitioners will remove the sand and rock revetment constructed on either side of their property, characterized by Petitioners as a "berm." Removal shall be accomplished by no later than May 1, 1997. In consideration for the Petitioners' agreement to remove the erosion control device, the Respondent will waive enforcement of the $1000.00 administrative fine.

Based on this agreement, as evidence by the signatures below, this action is hereby dismissed.

AND IT IS SO ORDERED.
