ORDERS:
CONSENT ORDER OF DISMISSAL
This matter is before the Court pursuant to a Petition for Review by Steve Thompson ("Petitioner")
seeking review of an Enforcement Order issued by the South Carolina Department of Health and
Environmental Control, Bureau of Ocean and Coastal Resource Management, ("Respondent"). Prior to the
date set for trial of the issues, the parties to the above-entitled action have agreed to settle the matter.
This consent order has been provided to the Court by the parties and represents their agreement that:
1. Petitioner agrees to replace the partial siding on the southern and western sides of the
pierhead with picket fencing. In addition the storage locker on the southern side of the pierhead will be
removed.
2. Respondent agrees to allow the storage locker and associated paneling to remain on the
eastern side of the pierhead.
3. Petitioner agrees to replace approximately six feet of the northern panel on the northeast
corner with picket fencing, as shown more fully in Attachment A and incorporated herein as part of this
consent order.
4. Respondent agrees to pay a civil penalty in the amount of two hundred and fifty ($250)
dollars within thirty (30) days of execution of this consent order.
5. Respondent agrees to withdraw Enforcement Order 96B-018L.
THEREFORE, with the consent of the parties, it is hereby ORDERED that Docket Number 96-ALJ-07-0554-CC is hereby dismissed with prejudice.
AND IT IS SO ORDERED.
