ORDERS:

ORDER AUTHORIZING AMENDED PERMIT AND DISMISSING CASE

This is a contested case in which the Petitioner seeks a review of the issuance by the office of Ocean and Coastal Resource Management ("OCRM") of permit number 96-1T-035-P, with conditions, to Island Preservation Partnership for the renovation of Dewees Island Marina, Isle of Palms, Charleston County, South Carolina.

It now appears that the parties have reached a settlement of this matter. Specifically, the parties have agreed that an amended permit should issue with the amendments being those set forth in the letter from Kenneth H. Hance, Newkirk Environmental Consultants, Inc. dated October 29, 1996, and attached hereto as an exhibit, including revised sheets 3 and 4 of the project drawings attached to said letter.

It appearing to the Court that the issuance of the amended permit is just and proper, and with the consent of all parties, it is therefore

ORDERED, ADJUDGED AND DECREED that an amended permit as set forth above shall be issued by the OCRM, and the within contested matter be dismissed with prejudice.



AND IT IS SO ORDERED!
