ORDERS:
ORDER OF DISMISSAL
This matter comes before me pursuant to S.C. Code Ann. § 1-23-310, et seq. (Supp. 1995).
Petitioner, Windmill Harbour Property Owner's Association, contested the South Carolina
Department of Health and Environmental Control's issuance of a commercial dock permit, with
conditions, to Keith Toomer at a location in the 100 block of William Hilton Parkway, Hilton
Head Island, Beaufort County, South Carolina. However, by petitioner's letter dated August 29,
1996, which is incorporated by reference, this tribunal has been advised that petitioner no longer
wishes to pursue a contested case and, therefore, withdraws its request for an adjudicatory
hearing. ACCORDINGLY, IT IS THEREFORE ORDERED that this matter is dismissed
with prejudice.
AND IT IS SO ORDERED.
