ORDERS:
ORDER
This matter is before me on Motion to Reconsider or Reopen Appeal pursuant to ALJD Rules 19,
20 and 29 filed by Mr. Ronald L. Motley. This case was disposed of by Consent Order dated
October 24, 1995. Mr. Motley now contends that errors were made in issuing the Consent Order
that adversely affect his rights as an adjacent property owner.
ALJD Rule 29 provides that a party may move for reconsideration. Mr. Motley is an adjacent
property owner with an interest in the outcome of this case, but is not a party to this action.
ALJD Rule 20 requires interested persons to move to intervene to become a party. Mr. Motley
has not complied with this requirement. He therefore is without legal grounds to move for
reconsideration of the Consent Order.
Further, ALJD Rule 20 allows ten (10) days for filing of a motion for reconsideration. Mr.
Motley's motion is dated November 17, 1995, and was received by the Administrative Law Judge
Division (ALJD) on November 20, 1995, some twenty-four (24) days after the date of the
Consent Order.
For the foregoing reasons, Mr. Motley's Motion to Reconsider or Reopen Appeal is DENIED.
AND SO IT IS ORDERED.
