ORDERS:
CONSENT ORDER OF DISMISSAL
TO: CHRISTOPHER McG. HOLMES, ESQUIRE.
This matter is before this Court upon an appeal of the decision of Respondent South Carolina Department of Health and
Environmental Control, Office of Ocean and Coastal Resource Management (SC DHEC-OCRM) to issue a dock permit to
Respondent Frederick Green (Permit Number OCRM-00-664 on October 31, 2001). Prior to the trial of this matter, the
parties informed this Court that the matter was resolved by agreement of all parties.
Upon motion and consent of all parties hereto, it is agreed as follows:
1. The single family recreational dock issued to Respondent Frederick Green will be realigned according to a revised plat of
W.C. Powers, surveyor, dated June 3, 2002 and attached hereto as part of this Order.
2. Harry C. Tiller, Jr., the Petitioner herein, agrees to a dock alignment shown on said plat and designated as "Black River
Properties Dock." Construction of this dock is subject to proper review of the pending application by SCDHEC-OCRM
and application of all appropriate regulations.
3. Consistent with these agreements, Harry C. Tiller, Jr. withdraws his appeal of the
dock permit (Permit Number OCRM-00-664) previously granted to the Respondent Frederick Green, with prejudice.
