ORDERS:

CONSENT ORDER TO STRIKE CASE FROM DOCKET PURSUANT TO RULE 40 (j)

Upon the motion of the petitioner and with the consent of the respondent, the above captioned case is ordered stricken from the docket pursuant to Rule 40(j) of the South Carolina Rules of Civil Procedure, with leave to restore the case to the docket upon motion made within 120 days of the South Carolina Supreme Court's resolution of the case styled South Carolina Coastal Conservation League and Sierra Club v. South Carolina Department of Health and Environmental Control, Office of Ocean and Coastal Resource Management; Port Royal Plantation; and Town of Hilton Head Island, Op. No. 3358, filed June 18, 2001. Between the date of this Order and the date this case is restored to the docket, if there should be such a Motion timely filed, any applicable statutes of limitation shall be tolled, according to the above Rule.
