ORDERS:
CONSENT ORDER OF DISMISSAL
This matter is before me by consent of all parties for entry of a Consent Order of Dismissal. This contested case is an appeal taken by
the Petitioner following OCRM's denial of a storm water permit. The Petitioner sought approval by OCRM of an application for a
storm water permit for construction of a residential development on the Cooper River in Berkeley County, South Carolina. OCRM
denied the permit based on its finding that the proposed project was inconsistent with the S.C. Coastal Zone Management Program
Document, and in particular, the policies therein related to protection of Geographic Areas of Particular Concern.
The Petitioner in this matter has agreed to withdraw his request for a storm water permit for this development, thereby eliminating the
current controversy. As evidenced by their signatures below, all parties consent to dismissal of the appeal.
It is therefore, ORDERED that case number 00-ALJ-07-0428-CC is hereby dismissed.
AND IT IS SO ORDERED.
