ORDER OF DISMISSAL

The above-entitled case is pending before the Administrative Law Judge Division. On May 23, 2000, the Administrative Law Judge was notified by Dunes West POA that Dunes West POA "has decided to rescind it's request for appeal." Such a decision by POA, the only party of record in opposition to the permit, leaves the permit uncontested.



In a telephone conference on June 12, 2000 in which all parties were invited to attend, the South Carolina Department of Health and Environmental Control, Office of Ocean and Coastal Resource Management (OCRM), Jay Thrower and Craig Lovette all agreed with Dunes West POA that the case is now in a posture of having no parties of record in opposition to the permit.





Accordingly, no controversy being in existence, this matter is dismissed and the case ended.



AND IT IS SO ORDERED.
