ORDER OF REMAND

On March 8, 2000, C. C. Harness, attorney for Store Creek Trust, filed a Motion to Remand on the ground that the parties are negotiating a reconsideration of the decision reached by the South Carolina Department of Health and Environmental Control, Office of Ocean and Coastal Resource Management (OCRM). OCRM agrees that it wishes to have additional time in which to explore its original decision and both parties agree that a reconsideration could eliminate the need for a hearing before the Administrative Law Judge Division (ALJD).



It is therefore ORDERED that judicial efficiency is best served in this matter by a remand to OCRM for the purpose of further review. Accordingly, this case is hereby dismissed without prejudice. Further, any party may timely file for a hearing before the ALJD should the dispute remain unresolved after further review by OCRM.



AND IT IS SO ORDERED.
