ORDER AND DECISION

STATEMENT OF THE CASE

This matter comes before the me pursuant to S.C. Code Ann. § 1-23-310 et seq. (Supp. 1995) for a hearing pursuant to the application of Randolphe G. Flowe, Professional Location Management, Inc., d/b/a Black Jacks Bar. The applicant seeks an on-premise beer and wine permit (AI 104991) for Route 3, Box 797A, Laurens County, South Carolina.

Notice of the date, time, place and nature of the hearing was timely given to all parties and to Joseph M. Pracht, protestant and attorney for Arthur Hipp, Bobby Fisher and other area residents. On January 3, 1996, the Court received a letter from Arthur and Joyce Hipp advising they would not attend the hearing and wished to withdraw their protest. On January 11, 1996, Mr. Pracht submitted a letter to the Court withdrawing as a protestant. Subsequently the Court held a telephone conference on January 16, 1996, with Mr. Pracht and Mr. Hite, wherein Mr. Pracht stated that not only did he wish to withdraw his opposition, but that he was no longer representing Bobby and Kathy Fisher and would attempt to contact them to so advise.

The hearing was held on February 8, 1996, at the Administrative Law Judge Division offices. Neither Bobby and Kathy Fisher nor any other protestant appeared at the hearing or made a Motion for a Continuance, thereby they waived any protest. After reviewing the file, and the evidence contained therein with the applicant, I have determined that all statutory provisions have been complied with for the issuance of the permit. Further, there being no opposition of record to the Petitioner's application, it is hereby

ORDERED that this matter is dismissed, and

IT IS FURTHER ORDERED that the Department of Revenue and Taxation continue to process the application of Randolphe G. Flowe, Professional Location Management, Inc., d/b/a Black Jacks Bar for an on-premise beer and wine permit (AI 104991) for Route 3, Box 797A, Laurens County, South Carolina.

AND IT IS SO ORDERED.
