ORDERS:
ORDER AND DECISION
This matter was pending before the Administrative Law Judge Division on the request of the
Petitioner for an on-premises beer and wine permit (AI-104974) for Morris Grocery & Grill located
at 5248 East Old Marion Highway, Florence, South Carolina. The on-premises application was
being protested by persons living in the vicinity of the proposed location. After the file was
transmitted to the Division for a hearing, the South Carolina Department of Revenue and Taxation
(Department) received a letter from the Petitioner requesting that the application be amended for an
off-premises beer and wine permit. Attached to Petitioner's letter was a letter from one of the
protestors indicating he would not protest an application for an off-premises permit. Thereafter, the
remaining protestors also wrote letters stating they had no objections to an off-premises permit.
The Petitioner's application for an on-premises beer and wine permit is being withdrawn.
Since the only matter pending was the application for on-premises permit and the Petitioner has
withdrawn that request, there is no need for a hearing. If Petitioner wishes to apply for an off-premise beer and wine permit, she shall contact the Department.
Therefore, the case pending before the Administrative Law Judge Division is DISMISSED
and the hearing scheduled for November 29, 1995 at 11:30 a.m. is cancelled.
