ORDER AND DECISION
STATEMENT OF THE CASE
This matter comes before the me pursuant to S.C. Code Ann. § 1-23-310 et seq. (Supp. 1994)
for a hearing pursuant to the application of Warren F. Langley, d/b/a Waterloo Food Store. The
applicant seeks an off-premise beer and wine permit (AI 104202) for RFD Old Laurens Highway,
Laurens County, South Carolina.
Notice of the date, time, place and nature of the hearing was timely given to all parties and
the eight protestants of record. Prior to the hearing two protestants of record submitted a letter to
the Court withdrawing their protests. The hearing was held on November 22, 1995, at the
Administrative Law Judge Division offices. The six remaining protestants failed to appear at the
hearing or to make a Motion for a Continuance, thereby, waiving their protests. Testimony was taken
at the hearing from which I have determined that all statutory provisions have been complied with for
the issuance of the permit. Further, there being no opposition of record to the Petitioner's application,
it is hereby
ORDERED that this matter is dismissed, and
IT IS FURTHER ORDERED that the Department of Revenue and Taxation continue to
process the application of Warren F. Langley, d/b/a Waterloo Food Store for an off-premise beer and
wine permit at RFD Old Laurens Highway, Laurens County, South Carolina.
AND IT IS SO ORDERED.
