ORDERS:
ORDER OF DISMISSAL
This matter comes before me pursuant to S.C. Code Ann. § 1-23-310, et seq. (Supp.
1994) for a hearing pursuant to the application of Marsha Hanberry-Freeman, d/b/a L & M
Liquors. The applicant seeks a retail liquor license (AI 0100813) for a location at 416 W.
Hagwood Street, Denmark, South Carolina.
An Order and Notice of Hearing was mailed to each of the three protestants of record.
However, notices mailed to Protestants Willie L. Brown and Reverend Jefferson returned to
sender. These notices were mailed by first class mail to Post Office Box 555, Denmark, South
Carolina 29042, the only address listed on the Department of Revenue and Taxation Transmittal
Form. After timely notice to the parties and Protestant Harry Nesmith, a hearing was held at the
Administrative Law Judge Division on November 20, 1995 in Columbia, South Carolina. The
protestants of record, Willie L. Brown, Reverend Jefferson, and Harry Nesmith, failed to appear
at the hearing, thereby, waiving their protest. Therefore, there is no opposition of record to the
petitioner's application.
IT IS THEREFORE ORDERED that this matter is dismissed.
IT IS FURTHER ORDERED that the Department of Revenue and Taxation continue to
process the application of Marsha Hanberry-Freeman, d/b/a L & M Liquors for a retail liquor
license at 416 W. Hagwood Street, Denmark, South Carolina.
AND IT IS SO ORDERED.
