ORDERS:
ORDER OF DISMISSAL
This matter comes before me pursuant to S.C. Code Ann. § 1-23-310, et seq. (Supp.
1994) for a hearing pursuant to the application of Leon H. Durham, d/b/a Griffin Grocery. The
applicant seeks an off-premises beer and wine permit (AI 103428) for 1804 Pumpkintown
Highway, Pickens, South Carolina.
After timely notice, a hearing was held at the Administrative Law Judge Division on
September 21, 1995 in Columbia, South Carolina. Reverend B. W. Moore, the protestant of
record, failed to appear at the hearing, thereby, waiving his protest. Therefore, there is no
opposition of record to the petitioner's application.
IT IS THEREFORE ORDERED that this matter is dismissed.
IT IS FURTHER ORDERED that the Department of Revenue and Taxation continue to
process the application of Leon H. Durham, d/b/a Griffin Grocery for an off-premises beer and
wine permit at 1804 Pumpkintown Highway, Pickens, South Carolina.
AND IT IS SO ORDERED.
