ORDER OF DISMISSAL

This matter is pending before the Administrative Law Judge Division pursuant to a protest by the South Carolina Department of Revenue and Taxation ("Department") against Richard M. Garrett's application of a business sale and consumption license. The Department's transmittal concerning the Application by Richard M. Garrett stated that the proposed location did not qualify for the license due to the statutory requirements of S. C. Code Ann. Section 61-3-440 (Supp. 1994) in regard to distance from a church.

This office has now been informed by Arlene D. Hand, attorney for the Department, in a letter dated August 8, 1995, that the distance was re-measured and it has now been determined there is no statutory prohibition against the issuance of the license. Therefore, she now requests that the hearing be cancelled.

IT IS THEREFORE ORDERED that the above matter be dismissed.
