ORDER OF DISMISSAL

In the above-captioned matter, the Respondent has advised the Administrative Law Judge Division, by letter dated July 3, 1995, that the Protestant, Chief Franklin McCallister of the Florence County Sheriff's Office, has withdrawn his protest. The Protestant initially opposed the issuance of an on-premises beer and wine permit (AI 103170) and a sale and consumption license (AI 103171) to James D. Kennedy, Shingles II and Peddle Pushers, Inc., d/b/a Shingles II. Upon withdrawal of this protest, there is no opposition to the Petitioner's application, therefore, a hearing is no longer necessary.

IT IS THEREFORE ORDERED that this matter is dismissed and that the Department of Revenue and Taxation continue to process the application of James D. Kennedy for an on-premises beer and wine permit and a sale and consumption license.

AND IT IS SO ORDERED.
