ORDERS:

ORDER AND DECISION

This matter comes before me pursuant to S.C. Code Ann. § 61-1-55 (Supp. 1993) and S.C. Code Ann. § 1-23-310, et seq. (Supp. 1993) for a hearing pursuant to the application of Andrew D. Williams, Jr. for an off-premises beer and wine permit (AI 101555) for a convenience store located at 208 Main Street, Town of Graniteville, County of Aiken, South Carolina.

After timely notice to the parties and protestant, a hearing was held at the Administrative Law Judge Division in Columbia, South Carolina. Donna C. Mitchell, the protestant of record, failed to appear at the hearing, thereby, waiving her protest.

Further, S.C. Code Ann. § 61-9-320 (Supp. 1993) establishes the criteria for the issuance of a beer and wine permit.

The applicant offered testimony which establishes that he satisfies the statutory criteria for holding a beer and wine permit.

IT IS HEREBY ORDERED that the Department of Revenue and Taxation issue an off-premises beer and wine permit to Andrew D. Williams, Jr. for 208 Main Street, Graniteville, South Carolina upon payment of the required fee(s) and cost(s).

AND IT IS SO ORDERED.
