ORDERS:
ORDER OF SETTLEMENT AND DECISION
This matter comes before the Administrative Law Judge Division for a hearing on the
application of William B. Velasco for an on-premises beer and wine permit for the Dinner House
located at 511 Foster Street in Union, South Carolina. The application was protested by Mr. R. F.
Roark, Director of the Union Public Safety Department. Notice of Hearing, scheduled for Tuesday,
November 1, 1994 was sent to the party and the protestant.
The applicant and the protestant have reached an agreement regarding the application and
through correspondence with the Division have communicated their settlement. The applicant has
agreed to a restriction on the issuance of the beer and wine permit. The restriction is that the business
will close at 2:00 a.m. each business day with the exception of any employee(s) who must remain for
the purpose of cleaning or maintenance. Based upon this restriction, the protestant has withdrawn
his protest.
The Administrative Law Judge Division has jurisdiction of contested and protested
applications under Title 61. S.C. Code of Laws § 61-1-55 (Supp. 1993). Since this matter is no
longer contested or protested, the file shall be returned to the Department of Revenue and Taxation
for further processing. If a beer and wine permit is issued to the applicant, it must be subject to the
restrictions agreed upon by the applicant and the protestant.
It is therefore, ORDERED that the protested application of William B. Velasco is settled with
the restrictions outlined in this ORDER OF SETTLEMENT. The Department of Revenue and
Taxation shall continue to process this application.
AND IT IS SO ORDERED.
