ORDERS:
ORDER OF DISMISSAL
This matter is before me for an order of dismissal of the within action by consent of the parties. This contested case is
before the undersigned by way of an agency transmittal from the South Carolina Department of Health and Environmental
Control (Department) directing the conduct of a contested case hearing due to the appeal by Mid South Water Systems, Inc.
of the Department's issuance of administrative order number 00-063-W. The Respondent is represented by Scott Elliott,
Esquire. The Petitioner is represented by Mason A. summers, Esquire, staff attorney for the Department.
Subsequent to the transmittal to this Court, the sole shareholder of the Respondent died. Subsequent to the death of the
Respondent's sole shareholder, both the wastewater treatment facility and the drinking water facility owned and operated
by Mid South Water Systems, Inc. were taken over by York County which wil operate them permanently.
Based on the foregoing the Petitioner and the Respondent consent to a dismissal of the matter pending before this Court.
Therefore, based on the foregoing, this contested case is dismissed.
