ORDERS:
SETTLEMENT ORDER
This matter comes before the Administrative Law Judge Division for a hearing on the
application of JoAnne T. Millwood for an on-premises beer and wine permit for The Party Shop
located at 203 North Gadberry Street in Union, South Carolina. The application was protested by
Mr. R.F. Roark, the Director of the Public Safety Department; Charles H. Potts, the City
Administrator; T.B. Williamson, Mayor of Union; and Fred Delk, the Director of the Downtown
Union Revitalization Association. Notice of a hearing, scheduled for September 14, 1994, was
sent to the parties and the protestants.
The applicant and the protestants have reached an agreement regarding the application and
through correspondence with the Division have communicated their settlement. The applicant has
agreed to certain restrictions on the issuance of the beer and wine permit. These restrictions are
that the business will close at 10:00 p.m. Monday through Saturday. On Sunday, the business will
be closed all day. Based upon these restrictions all of the protestants have withdrawn their
protests.
The Administrative Law Judge Division has jurisdiction of contested and protested
applications under Title 61. S.C. Code of Laws § 61-1-55 (Supp. 1993). Since this matter is no
longer contested or protested, the file shall be returned to the Department of Revenue and
Taxation for further processing. If a beer and wine permit is issued to the applicant it must be
subject to the restrictions agreed upon by the applicant and the protestants.
It is therefore, ORDERED that the protested application of JoAnne T. Millwood is
settled with the restrictions outlined in this SETTLEMENT ORDER. The application file is
returned to the Department of Revenue and Taxation for further processing.
AND IT IS SO ORDERED.
