ORDER OF DISMISSAL

This matter is before the Administrative Law Judge Division ("Division") pursuant to the Agency Transmittal filed on September 11, 2002. Petitioner was requesting a contested case hearing concerning its application for an off-premises beer and wine permit. The Department of Revenue had denied the application based on the protest of Jack C. Wilson, Jr ("Protestant"). The Department filed a Motion to be Excused on September 10, 2002, stating that it would have granted the permit, but for the Protestant's objection. On September 25, 2002, the Protestant notified this office that he wished to withdraw his protest. Accordingly, this case is dismissed.

IT IS HEREBY ORDERED that this case is dismissed.

AND IT IS SO ORDERED.
