By letter dated October 1, 2002, James H. Harrison, attorney for Petitioner, informed this tribunal that Petitioner is no longer interested in pursuing his application for an on-premises beer and wine permit for 301 South Plantation Road in Lancaster, South Carolina. Petitioner therefore requests that this matter be remanded to the South Carolina Department of Revenue so that he can withdraw his application. Accordingly,

IT IS HEREBY ORDERED that the hearing of this matter currently scheduled for Tuesday, October 8, 2002, is CANCELLED.

IT IS FURTHER ORDERED that this matter is REMANDED to the South Carolina Department of Revenue, whereupon it shall treat Petitioner's application as having been withdrawn.

AND IT IS SO ORDERED.
